Terms and Conditions of Sale

1. The service
Synthetic Swarm provides professionals with prospect profiles containing contact names, professional contact details and a reason to reach out. Features and volumes depend on the selected plan.
2. Subscription
Subscriptions are purchased online. By confirming a subscription and accepting these terms, the Customer enters into a contract with Synthetic Swarm for business purposes.
3. Pricing
The applicable prices and volumes are those shown on the Pricing page at the time of subscription. Unless stated otherwise, no discounts or reductions apply.
4. Payment
Subscriptions are billed monthly and paid by card through Stripe. Late payments incur the penalties required by applicable regulations, together with a fixed €40 recovery fee.
5. Term and renewal
The subscription runs for one month and renews automatically each month until cancelled. The Customer may cancel at any time through their account.
6. Delivery of prospect profiles
Synthetic Swarm provides the volume of prospect profiles included in the selected plan. Information may change over time, and Synthetic Swarm makes reasonable efforts to provide relevant, usable profiles.
7. Use of prospect profiles
Profiles are intended exclusively for the Customer’s professional prospecting. The Customer remains responsible for their calls, messages and all other uses of the information provided.
8. Resale and redistribution
The Customer may not resell, rent, publish or share the profiles or the Synthetic Swarm database with third parties. Profiles may only be used for the customer organisation’s own needs.
9. No guarantee of commercial results
Synthetic Swarm helps identify and prioritise prospects but does not guarantee meetings, sales or conversion rates. The information provided supports prospecting and must be assessed by the Customer.
10. Data and contact details
Contact details and other information may come from public or professional sources and may change after collection. Details of how personal data is processed are set out in our Privacy Policy.
11. Intellectual property
The website, platform, methods, software, algorithms, databases and Synthetic Swarm brand assets remain the property of Synthetic Swarm. A subscription grants only the right to use the service for its duration.
12. Commercial references
The Customer permits Synthetic Swarm to use their company name, trademark and logo to identify them as a customer on its website, in presentations and in commercial materials.
The Customer may withdraw this permission at any time by emailing contact@syntheticswarm.ai.
Testimonials, photos and case studies require separate approval.
13. Access and availability
Synthetic Swarm may perform maintenance or update the service and its features. We use our best efforts to keep the service accessible, without guaranteeing continuous or uninterrupted availability.
14. Suspension
Synthetic Swarm may suspend access to the service in the event of non-payment, misuse, attempts to compromise the service or a material breach of these terms.
15. Cancellation
Cancellation stops any further renewal. Fees for a period that has already started remain payable unless Synthetic Swarm expressly agrees to a refund.
16. Confidentiality
Each party agrees not to disclose confidential information received from the other during the business relationship, unless required by law or authorised in advance.
17. Liability
To the extent permitted by law, Synthetic Swarm is liable only for direct damage resulting from a fault attributable to it. Synthetic Swarm is not responsible for the Customer’s commercial decisions based on the profiles provided.
18. Force majeure
Neither party is liable for a failure caused by a force majeure event under French law for the duration of that event.
19. Changes to the service and terms
Synthetic Swarm may update the service and these terms. Any material change affecting an ongoing subscription will be communicated to the Customer before it takes effect.
20. Governing law
These terms are governed by French law. In the event of a dispute, the parties will first seek an amicable resolution before starting proceedings.
